Dropped Gun Injures Baby - Dad Charged

A 20-month-old boy shot through the shoulder while riding in a stroller last week in East Oakland was wounded after a pistol accidentally fell from his father's pocket and went off when it hit the pavement, authorities said Thursday.



Authorities said the boy's father, Onisema Tua, 23, has been charged with three felony counts in the shooting: child abuse likely to cause great bodily harm, carrying a concealed firearm and carrying a loaded firearm.




Tua has pleaded not guilty to the charges and is scheduled to appear in court Thursday. He is being held at Santa Rita Jail on $180,000 bail. Officer Mike Troupe, the lead investigator, said a remorseful Tua admitted his involvement but did not turn the gun over to police. 

Troupe said Tua said he carried the gun for protection.


The shooting happened about noon Sept. 11 in the 2600 block of 77th Avenue as Tua, his wife and the boy were walking home from Eastmont Town Center. The boy was in a stroller being pushed by Tua.
 


Police said Tua had a semi-automatic pistol in his front pants pocket. As they were going up a hill, the gun got loose and fell from the pocket, going off when it hit the pavement, police said.

    Actually Anon, the majority of newly manufactured firearms include a mechanism that prevents the firing pin from striking the primer unless the trigger is pulled.
    The Kimber pistol I routinely carry, while based on the venerable Colt 1911 design, also includes this feature. Since 2001, California has required handguns to pass a drop test for it to be certified as safe to be in the state. And I see that my pistol is included on the list.
    I wonder if at some point, we'll find out if this pistol is on the list. Guns are required to be registered in the great state of California and I see no mention of a charge involving the possession of an unregistered firearm. If it is registered, it would be a simple thing to determine if the gun had passed the drop test.
    My belief is that most of these "accidents" that occur when a firearm is dropped are in reality negligent discharges because someone had their finger or something else on the trigger.

    1. Thanks for mentioning the lack of charges related to the possession of the gun. He was yet another lawful gun owner (hidden criminal perhaps) who was actually unfit to own guns.

      You always say that about the dropped gun discharge phenomenon, but I'm not buying it. There are just too many of these.

      If we knew the model of gun he was carrying, it would be a simple thing to determine whether there were any safety features in the design.
      My pistols design has been tested and certified by California which includes dropping three test guns six times from different positions onto concrete with the safety off. If any of the test guns dent a primer, then no certification.

    1. The "drop" test is what happens in everyday use out in the public, and we constantly read how guns go off merely by being dropped. Unless gun loons are lying to police in order to escape serious charges. No, not possible.
