New York Man Arrested Immediately for Accidently Shooting his 9-Month-old Daughter - Wife Arrested Too

Local news reports

The parents of a 9-month-old baby in East New York were arrested when the infant was accidentally shot, according to police.

Police charged 47-year-old Pedro Rosales with shooting his daughter in their Sutter Avenue apartment about 4 p.m. Saturday when a silver Colt .45 gun in his possession accidentally discharged while cleaning. The baby was struck in the lower abdomen, according to police.

The mother, 24-year-old Jessica Aguilar, was home during the shooting and was arrested as well. Police determined the shooting was an accidental discharge after interviewing Rosales.

He was charged with assault, acting in a manner injurious to a child, reckless endangerment and criminal possession of a weapon.

  1. Of course, the criminal possession of a firearm likely had nothing to do with the immediate arrest in the gun control nirvana....

    1. It shouldn't. He should have been arrested no natter what his previous criminal history.

    2. That's one of my points, Fred. Accidentally shooting a kid is often not enough go get arrested but being a felon in possession of a gun is. Somethings very wrong with that.

This case also has the wife getting arrested too, which I found odd.

    3. Accidentally shooting a kid is often not enough go get arrested but being a felon in possession of a gun is. [Something's] very wrong with that.

Precisely, Mikeb. Can I count on your support in the effort to repeal the state-mandated defenselessness of felons whose debt to society has been paid?

    4. Mike, in this case we don't know that since NYC is one of the gun control nirvanas where people typically hire an attorney to help them jump through the bureaucratic hoops to just keep a firearm in the home.
So in this case, they might very well been arrested for any number of other reasons including wounding the child. My guess is the wife got picked up on a possession charge. A her home, her responsibility thing.

    5. Agreed, and I still wonder about the mother being arrested. No mention about her charges in the news report.

    6. "As CBS2’s Ilana Gold reported, the father, 47-year-old Pedro Rosales, was behind bars at the 75th Precinct Sunday morning in connection with the shooting of Jessica Rosales.
The mother, Jessica Aguilar, 24, is facing charges for failing to supervise."

"The couple also face reckless endangerment and weapons charges, WCBS 880’s Monica Miller reported."

"As CBS2’s Steve Langford reported, the couple failed to provide a straight story about how it happened, according to police, who said Rosales shot the little girl in the hip while cleaning an unlicensed Colt .45 handgun in his East New York apartment."

"Police said Rosales has been previously arrested on weapons-related charges."

    7. So they also lied to police.

    8. Thanks for the additional details, ss. Now it seems like they committed two very serious mistakes, lying to the cops and being Hispanic.

  2. What was the mother charged with?
