Florida Man Arrested Immediately for Accidentally Shooting (Killing) His Friend

A South Florida man is facing manslaughter charges after an accidental shooting death. 

The Miami Herald reported Monday that Josue Sanchez was arrested after he mishandled his gun and fatally shot 19-year-old Lazaro Martinez in a Hialeah parking lot Friday night. 

Hialeah police say the 20-year-old Sanchez, Martinez and another person were smoking marijuana in a parking lot and were taking photos with the gun. Sanchez pulled the trigger, striking Martinez, who died Saturday. 

Police say Sanchez was charged with manslaughter because he displayed a reckless disregard for safety while under the influence.

    4. Negligence is a reason for an accident occurring. To say it is not an accident is to say it was done on purpose. The correct thing to say in this case is that it is an accident caused by negligent behavior.

    8. Ah yes, we have to accept your definition of accident and negligence no matter what a dictionary says. Just like we have to accept the gun loon version of the interpretation of the 2nd A, because you gun loons are correct and there could not possibly be any other definition, or interpretation.     9. Did you even bother looking at a dictionary before appealing to the definition of "accident"? Because the dictionary confirms what I said:

      1. an undesirable or unfortunate happening that occurs unintentionally and usually results in harm, injury, damage, or loss; casualty; mishap:
      automobile accidents.

      The definition is based on intent.

    10. Fine. Kurt is right that a negligent discharge can be called accidental. Nevertheless, doing so is to divert the focus from the responsibility of the shooter and onto the "unfortunate happening."

      A three car accident caused by a drunk driver left two people dead and two other hospitalized.

      Would you call the use of the word “accident” diverting focus from the responsibility of the driver? I wouldn’t. Or is this only a gun thing for you?
