Nelson Georgia Amends the Mandatory Gun Statute - Big Victory for the Brady Campaign


The town of Nelson, George settled its dispute with the Brady Center to Prevent Gun Violence over a city ordinance that would have required every resident to own a gun and ammunition.
“The City will amend the ordinance to make clear that the Constitution protects the individual right to maintain a gun-free home,” the Brady Center said in a statement. “The amended statute will say that the gun ownership mandate cannot be enforced and that there will be no penalties for non-compliance.”
Nelson had passed the ordinance on April 1st—and it apparently was not an April Fool’s joke—requiring all residents to own a firearm, barring those with disabilities, felons, or those whose religious beliefs conflicted with the law. The Brady Center filed suit, alleging the ordinance violated the First, Second, and Fourteenth Amendments.
The Nelson City Council voted 5-0 to accept the new language.

That's a pretty weak victory for our side. The statute as originally written allowed for gun free homes. It always was a symbolic pro-gun statement, nothing more. Now, what, is it supposed to be clearer that the town council of Nelson GA is nuts?

A tiny Georgia city and a national gun control group are facing off in a legal battle over a city ordinance requiring gun ownership, with the constitutionality of the law and broader messages about gun rights taking center stage.

The Brady Center to Prevent Gun Violence in May filed a federal lawsuit against Nelson, a city of roughly 1,300 residents about 50 miles north of Atlanta, saying a recently adopted ordinance requiring heads of household to own a gun and ammunition is unconstitutional.

Here's the genius rationale behind the law:

"I am still firmly in favor of the law," resident Lawrence Cooper said. "I believe that if everyone had guns crime would disappear."
