6-Year-old Toms River, New Jersey Boy Killed by a 4-Year-old with Daddy's Rifle

The 6-year-old boy accidentally shot in the head by his 4-year-old neighbor has died, authorities said.
Brandon Holt died tonight at Jersey Shore University Medical Center in Neptune.

Authorities said today Brandon and a 4-year-old neighbor were playing in the younger boy’s backyard Monday night when the pre-schooler went in his house, brought out a loaded .22-caliber rifle and shot the older boy in the head.

Another neighbor said police removed several other weapons from the younger boy’s home.
Police were investigating, among other things, whether the adults in the house were legally permitted to own the rifle.

No charges have been filed but the investigation continues. The case has been transferred to the Atlantic County Prosecutor’s Office because of a potential conflict of interest with a relative of the 4-year-old boy having a job in Ocean County law enforcement, authorities said.
It's hard to understand why an investigation would need to continue. The homeowners who were responsible for those guns should already be in the slammer.

  1. Again, gun incidents are the only ones in which you demand for a suspension of due process. The case is being dealt with properly. Let the system work.

    Of course, this being New Jersey, one of the worst states in the nation--for gun control and many other things--something like this should be impossible, right? After all, the state has the idiotic laws that your side wants, and we don't appear to be talking about a gun that was sneaked in from a free state.

    1. Correct, we do NOT throw Due Process out the window because there was a firearm involved in the potential crime. Give investigators a chance to process the scene, gather evidence, and present the details to the prosecutor and/or a Grand Jury. Then the prosecutor can press charges and issue an arrest warrant if appropriate.

      I believe the homeowner who allowed his 4 year old son to "play" with his loaded rifle should be tried for (and from the sound of the story be convicted of) involuntary manslaughter or maybe even negligent homicide.

    2. Due process is not violated when someone is arrested for drunk driving or urinating in public. Those and many other crimes do not require a lengthy investigation.

      It will help when all guns are registered. That way the responsible person would be all that much easier to identify.
