The White House is introducing a new requirement that would expand background checks for buyers. The measure mandates that individuals "in the business of selling firearms" register as licensed gun dealers, effectively narrowing the so-called "gun show loophole," which exempts most small sellers from keeping formal sales records.

I didn’t get the impression that he is going to relax the requirements or ease of getting a FFL, did you? They want to put the squeeze on from both ends. Make it harder to have a FFL (as Clinton did), and also make it more illegal to sell without having a FFL. Rolling back to the days of “kitchen table gun dealers” would actually do more for Obama’s stated cause than his little speech, but I doubt we will see that.

DeleteHe has billed this executive order as an attempt to more accurately define who is in the business of selling firearms with the intent of requiring those people to get an FFL which would require them to conduct their sales as an FFL with the requisite NICS background check.
DeleteSo I have no problem seeing the ATF trying in its own never subtle or common sense way to see how many people they can prosecute by trying to prove their in the business of selling guns.
The EO didn't really apply any clarification, but it gives the ATF, a direction to run in until they hit the wall of legality. After all, look how well Fast and Furious worked out.

DeleteI never expected to be defending His Obamaness, but what would you, as a rabid "gun control" fanatic, have him do that he isn't doing already? The power of executive orders is limited--as it must be. I think it should be limited more than it is, and I think Obama is overstepping even the excessive power that Presidents wield through such orders--and you're getting pissy because he isn't stretching his authority even further?
So again I ask, what--specifically--kinds of executive orders do you want him to issue, keeping in mind that even these that he has issued are likely to face legal challenges that I dearly hope strike these vile atrocities down?
I don't know how far he can go. Licensing of all gun owners and registering of all guns followed by background checks on all transfers is, I suppose too much. So, at least he could have decided what constitutes a private seller - say no more than one transfer every six months. But, of course, how could we know without the licensing and registering requirements?

DeleteI am sure that it is nothing more than a symbolic victory. Yet it is an important historical milestone, none the less. What makes me laugh is the virulent response from the clown car. The president touched on just about every important issue that you have exposed as considerable in your blog for the last five years or more. I, for one was extremely impressed. I am also one of those who find him inspiring. We love the guy. Like Kennedy or Clinton.

We'll see. Although infinitely better than any one of the Republican clowns, my disullusionment with Obama is about complete. And I'm bracing to go into a Hillary Clinton administration which will be just more of the same. If I ever move back to the States I'm gonna see if Orlin has a cave best door that I can rent.

What’s funny is how Obama spends seven years bitching that we don’t have enough guns laws, and then holds a press conference where he repeats what our current gun laws are and then pats himself on the back for taking a bold action against gun rights.

It does seem to me that he might sick his AG on some marginal cases of gun sellers to make examples of them. Since there has never been a clear definition of “in the business” any good person could get caught up in this. I expended him to clearly define what a “gun dealer” is, but he didn’t do that.
Of course he could have taken real executive action to truly expand background checks by requiring the FBI to come up with a mechanism for DIY checks. That is actually within his purview as long as he’s not creating crimes around it. But no, they don’t want to give up crying about “background checks” as a way to squeeze the culture. Something that expands background checks without limiting gun rights is not part of the plan, because background checks were never the end goal, but rather a way to limit rights (which is the true end goal).
