Accidental Shooting of ND Man by Himself - No Charges

The Daily News reports


A Christine, N.D., man was transported to the hospital after accidentally shooting himself about 10:30 p.m. Monday.

Cory Robertsdahl, 48, Christine, was transported to Essentia Health in Fargo by family members after he accidentally shot himself in the right leg with a .22-caliber weapon. According to the press release, his injury was believed to be non-life threatening. He remains at the hospital at this time, said investigating officer Steve Gjerdevig, Richland County Sheriff’s Office.

This incident remains under investigation by the Richland County Sheriff’s Office.
What's your opinion? Is there a fundamental difference between this type of negligence and that which results in someone getting killed or seriously injured? No, there isn't. The gravity of these incidents should not only be judged by the end result.

    2. As long as another citizen loses his gun rights, it's all good--right? Mikeb, I take it that you never have any accidents? You set an impossible standard, given that we're talking about human beings here. Our rights shouldn't be subject to the occasional accident.

      I am sorry to hear about this accident, however I am glad he is not in critical condition. Support to Cory and his family, may he have a fast recovery. Gun accidents are the saddest of them all, while I do not know the circumstances, I am positive this was an ACCIDENT and not horse play or carelessness.

    4. I'll explain this to Anonymous, but you Greg should already understand it. There is no such thing as an accident with a gun. It's always negligence. The reason is in every single case one or more of the 4 Rules of Gun Safety has to be violated. That's negligence and that's why people who do that should lose their gun rights.

    5. No, I don't understand it. I don't see that a person should lose his rights for an incident like this. He only hurt himself.

    6. Greg, you understand it very well you're just playin' hard to get.

      The exact same negligence sometimes results in the death of a kid. In this case the guy only hurt himself, but the wrongdoing was exactly the same as those cases in which the end result is much worse.

      Why do you want to protect people like this? If he did kill a kid would you then agree to the loss of gun rights?

    7. I look at it the same way as I see vehicular homicide. In some cases, it's bad all the way around, but it was an accident. When negligence is involved or substances or something similar, we're moving into felony territory.

      Prosecutors are good at determining these things. Too good, on various occasions, in fact. But when no one or when just the shooter gets hurt, that's not a crime, and we shouldn't take rights away from someone who commits no crime.

  2. Why do you say “no charges” when you also posted this:

    This incident remains under investigation by the Richland County Sheriff’s Office.

    Would your headline on September 12th, 2001 read: “Terrorists fly planes into world trade center killing 2600 people- no charges.”

    In general, you should give police time to complete their investigation, and then complain if you must. A thorough investigation could even lead to more serious charges that might not happen if they press charges prematurely under cursory evidence. You could miss out on a murder charge by pressing charges for accidental homicide on the spot.

    1. You're right. Why don't you keep an eye out for the ones that turn into more serious charges than originally considered.

      I'll watch for those that result in nothing and/or a slap on the wrist.
