Ohio Man Shoots and Kills Himself with Friend Gun - No Charges

Local news reports

A Newark man was killed last night when a gun he was handling accidentally fired.

Christopher Byerly, 23, was visiting a friend at 569 E. Main St. Newark Police Sgt. Paul Davis said that Byerly was carelessly handling a firearm that belonged to the resident.

When the gun owner tried to retrieve the gun, Davis said, Byerly pulled away. His thumb got caught in the trigger guard and the gun fired, shooting Byerly in the chest.

Byerly, of 88 N. Buena Vista St. in Newark, was taken to Licking Memorial Hospital, where he died.

Davis said there was no evidence of any criminal activity.

‘It was completely accidental,” said Davis. “We don’t anticipate any type of criminal charges being filed.”

That's not an accident, it's an idiot mishandling a gun.

Actually it was completely negligent, IMHO. Standard practice is to hand someone a firearm properly cleared. Though in this case, it sounds like the guy was monking around with the gun without permission. And when the owner tried to take it back, the victim shot himself. Hard to charge a dead guy, though I dont think he'll ever do it again.

    2. "Does the gun owner bear no responsibility?"

"According to the Newark Division of Police, Byerly was mishandling a gun that he had borrowed from a person in the residence, when the owner attempted to take the firearm back.
Police said Byerly then attempted to pull the gun away from the owner, and while doing so, somehow accidentally pulled the trigger, shooting himself."

He observed improper handling and took the gun back. Then it looks like the now dead guy tried to take it back without permission. Not seeing any.

    1. Well Anon, you seem quite willing to trust whatever the media says when it supports your argument. In this case, they were quoting a representing the police department.
Do you have some information that disproves the quote?
