The South Carolina Shooter - Dylann Roof

Roof is from the town of Eastover, around 150 km north-west of Charleston. According to the state law enforcement division, he was arrested on 1 March 2015 for drug possession and again on 26 April on a trespassing charge.
Roof's uncle told Reuters he recognised his nephew from the CCTV image (above) and that he had received a gun for his 21st birthday in April. A photograph from Roof's Facebook page shows him wearing a jacket with the historical flags of apartheid-era South Africa and Rhodesia (now Zimbabwe) on it.
Dylann Roof was stopped in his car and arrested, following a tip-off, on Thursday 18 June in the city of Shelby, North Carolina around 400 km north-west of Charleston.
During the manhunt police described him as "highly dangerous" and said they had "no doubt" the shooting was a hate crime.

I think Beale nailed it as far as the main concern to your readers. Roof bought his gun at a used gun store with no background check. With his pending felony case for possession of narcotics, federal law should have prevented him from buying a gun. The so-called private sale loophole. This would also include the gift transaction from his father of a .45 on his birthday. "Yes sir, Dylann, you're a man now, it's time for you to own a gun. Congratulations, son, you've earned it."

DeleteA valid justification for a universal background check requirement continues to not exist. It never has existed. It never, ever, ever, will.
Oh, and if it's true that he bought a gun at a gun store--used or not--then federal law requires a background check for the sale. That would of course mean that either he passed the vaunted background check, or that despite a law requiring it, the sale proceeded (illegally) without it. Either way, it's hard to imagine how the "universal background check" pushers hope to make much hay from this.

DeleteTTAG is already promoting a version of the events in which they state that Roof passed the Brady Bill background check. Except, the source article from CNN makes no mention of this.

DeleteFJ, FFLs are required to run an NICS check with every sale. If the FFL didn't run the check, there is some bad medicine heading their way. If the gun used by Roof was purchased by him with an accompanying NICS check, it sort of shoots down the argument about loose gun laws causing this event.
I haven't seen anything to refute Southern Beale's or Flying Junior's idea that he benefited from the loophole, but even if he did, there are many 21-year-olds who can pass the standard NICS but would never pass any other control, psyche exam, medical exam, may issue permiting, etc.

Funny how you got on me for what you called "hypotheticals" but here you hypothetically propose with certainty that he would "never" be able to pass what you call a "proper gun control" screening. Your are quite positive he couldn't help but blurt out "I want permission to buy a gun so I can commit mass murder at a black church in hopes that it kicks off a race war" when asked why he wants to buy a gun by a psychologist.

ReplyDeleteAn interesting concept FJ. I'm honestly not familiar with when a prohibited persons name is entered into the NICS database. Upon being charged? Or after conviction? And of course, the next question is how often does the data get entered into the system.
Be that as it may, it could be reasonable to assume that the father would have known about his son being arrested and charged. Maybe we'll be hearing about dad being charged in the future.
I didn't want to complicate the argument unnecessarily, but when I heard he was a 21 year old kid, the first thing I thought is imagine what kind of South Carolina family he grew up in.

Freedom comes with responsibilities. I would be irresponsible not to check and see if certain people should not have the right to a deadly weapon. The laws we make are to ensure the safety of all, compared to denying the freedom of individuals to do whatever they want.
