Raul Rodriguez, Dangerous Concealed Carry Permit Holder, Gets a New Trial


Legal Insurrection

To summarize: beginning in the early evening hours of May 1, 2010, retired fire fighter Raul Rodriguez grew increasingly angry with a loud party being held down the street by eventual victim Kelly Danaher, who was throwing a birthday party for his wife.

By the early morning hours of May 2, 2010, Rodriguez decided to strap on his pistol (which he was licensed to carry concealed), at least one spare magazine, and bring a flashlight and a means to video record to stand across the street from the party.  He then proceeded to simultaneously call 911, shine the flashlight repeatedly at the party, and record events.  Eventually he attracted the attention of the party goers, who came over to speak with him, and events proceeded rapidly downhill from there, culminating in Rodriguez shooting and killing Danaher.

From my perspective perhaps the most striking part of this encounter is how badly astray Rodriguez is led by his remarkably defective understanding of self-defense law.  His self-recording of his repetitive announcements of “I am in fear for my life” and “I’m standing my ground” suggests he feels the mere words alone bestow some magical legal protection or authority at best, or that he was attempting to fabricate a faux self-defense claim at worst.

    2. Ease of Google does not equate statistical evidence in your favor. Compare the rates of criminal activity with a firearm, by a CC...versus any other category, then get back to me.

      I can likewise uncover stories every day [within minutes], of defensive uses of firearms. Why don't you post those accounts?

    3. Actually, using Google you lose big time. There are twenty (or so) times more stories of gun misuse than DGUs. I agree it's not proof, but it sure is indicative.

    4. Wait..you mean our vaunted media [rife with gun control supporters] doesn't post as many stories of DGUs? Shocking. I'd be happy to provide you these events as often as you care for, then we could certainly see how they stack up against reporting of misuse by CC-ers.

  3. So after spending around three years in prison, Mr. Rodriquez get a new trial. And he might be convicted yet again. And he even provided a good amount of the evidence used against him.

    1. The point is, in case you missed it, is that many concealed carry guys are like poor Raul, frightened, contentious, paranoid, insecure and with a poor understainding of what stand your ground and castle doctrine really mean.

      Right. So maybe you guys should start being more honest about what it really means then. I never hear you guys talk about Innocence, Imminence, Proportionality, Avoidance, and Reasonableness. Instead you make it sound like all you need to do is utter the magic words "I felt in fear of my life", which is actually what this guys seemed to be following.

    6. I believe the vast majority of "gun fanatics" are wise enough to not believe a word you guys say. What's clear is that the only proper information about self defense law comes from people who support armed self-defense and gun rights. Legal Insurrection (the link you provided) is a great example, as well as the talks from Massad Ayoob. There is absolutely nothing like that from gun control people- instead we are fed gross misinformation. I have not once seen a gun control person utter the words "Innocence, Imminence, Proportionality, Avoidance, Reasonableness". You could be the first, Mike. Why don't you give us a little talk on what those five words mean as it relates to self-defense law? I am quite confident you won't do it. Heaven forbid you say anything that makes SYG sound reasonable.

    10. Ugg. Read what I asked again, Mike. I did not ask you to make a post of an example of someone with a bad misunderstanding of SYG. I said do a post on the proper meaning of SYG. What does it protect, what doesn't it protect. Show us that your understanding is good, while also working to spread good information, specifically highlighting what actions it doesn't protect in an effort to reduce cases of misunderstanding the law.

      So far I'm winning my bet that you'll refuse to do this.

    14. TS, It's not the comments by you gun rights fanatics that make the difference, it's mine and the others who oppose what you say. We're the ones calling for safe storage and proper gun handling. All you do is argue against anything we say including the call for better laws even if they make sense.
