Weer'd Thinks, Fails


Weer'd thinks about Hate Crimes:
As much as it disgusts me to hear about “Hate Crime”, I see no valid reason to judge the crime any differently than crimes of passion, or crime for profit, or “honor killings” like this. You judge a man by his actions, not by what’s in his mind, or heart, and not by the tools in his hand.

This is odd for several reasons; first, Weer'd has been pretty much ok with white males shooting and killing people. But the second and larger point is that such thinking goes entirely against our entire system of justice which does account for intent. Laci can address this far better than I but IIRC there are around 20 categories of homicide that one could possibly get charged with. There's a world of difference between someone who plots a murder for months and carries it out and someone who gets into a bar fight and accidentally kills someone. Similarly, there's a ton of difference between someone spray paints a swastika on the side of a Synagogue and someone who paints "Red Sox Rule" on a garage door.
Pretty strange coming from Weer'd who believes the ATF goes after FFLs for making "typos."

    Oh dear, those opinions came from Justices Douglas and Stevens: two of the longest seated Supreme Court Justices (one of who was on the Court at the time of Miller). He can't claim that I plagiarised them either since the quoted opinions were properly cited.

    I'm flattered he thinks I wrote those decisions.

  3. I'm not sure what point Anon is trying to make.

    Oh yes, Weer'd knows more than lawyers who have been practising for twice his lifetime. He demonstrates an astonishing level of self-belief in his knowledge of law. It suggests that, by instinct or by birth, he knows more about this subject (since he shows no sign of ever having studied it) than the supreme court justices who have spent their careers working in that field.

    mens rea is not thought crime, but a part of the definition of the crime.

    For example, one must act "knowingly" in the firearms statutes: An example from 18 USC 922 (a)(1)(C)(5)
    for any person (other than a licensed importer, licensed
    manufacturer, licensed dealer, or licensed collector) to
    transfer, sell, trade, give, transport, or deliver any firearm to
    any person (other than a licensed importer, licensed
    manufacturer, licensed dealer, or licensed collector) who the
    transferor knows or has reasonable cause to believe does not
    reside in (or if the person is a corporation or other business
    entity, does not maintain a place of business in) the State in
    which the transferor resides


    For a conviction to happen, there must be a demonstration of knowledge or something which would provide reasonable cause to believe that the person is from out of state.

    The state of mind relates to the crime which is the difference between something such as premeditated murder and manslaughter.

    By your logic, you are saying the ATF is right. That the ATF should prosecute FFLs regardless if they actually did make a "typo" or they were illegally trafficking firearms.

    Similarly, you seem to be saying we ought not distinguish between someone who accidentally kills someone and someone who deliberately plots to murder and does so.

    For the record, you and your fellow gunloons have no problems threatening people with whom you disagree. Then you and your fellow gunloons gloat when people are driven from posting their views or opinions.

    I realize you're going to say something along the lines of "I've never {{fill in the blank}}. Which may or may not be true but you've remained silent when your fellow gunloons do it. The only time you squawk is when we, on the pro-gun control side, don't roll over and acquiesce to your bullying. Want to tell us how many times you whined when a gunloon accused us of being molesters or worse?

    Take Linoge, for example. He claims he wants nothing more than "open, honest and rational" discussion of the issues. Sounds good, huh? I think so as well. But the very same folks he wishes to have "open, honest and rational" conversations with, he has claimed are "criminals" "violent criminals," "bigots," "cowards,""PSHers,""liars""spineless violent cowards" and the like.

    Apparently, Linoge's idea of "open, honest and rational" conversations involve him spewing vitriol at someone and that someone meekly accepting it.

    And truth be told, Linoge isn't the worst of the lot. Your fellow travellers include those who like to issue death threats or threats of violence. You have those who will repeatedly associate us on the other side of being sex offenders and the like. I've had one of your buddies tell me that it'd be a shame if anything happened to my family because I didn't keep my mouth shut. This was accompanied by mapquest directions to my home.

    So, Ruffy, please spare me the clutching of your pearls.

    1) You would have to provide proof that I indeed made the post. The only way I know how to do that is to have administrator privileges to this blog.

    2) Having blogs on Wordpress and Blogger, I know for a fact that Wordpress gives the administrator this information and Blogger does not.

    3) If you are going by the geolocation information provided by this site, that information is unreliable.

    4) That is why you must provide an actual IP address and not geolocation information as the anonymous poster requested.

    5) Likewise, you must provide more than just that I was on this site, but that I actually made this post. Again, you cannot offer this proof.

    If you have information on where I am posting, please tell me from where I am posting this (it's not in the USA).

    I just posted his IP address: he looked up my "home address", Tax information on that property, and lord knows what. He even posted that information on his blog in the Titfortat post.

    I kinda hate to burst your mad Intertubez Skillz but since I moderate the comments, I see the IP addresses. I can state our vistors from HK and, yesterday, Singapore seem to be more interested in posting ads about discount Ed Hardy apparell than anything we're talking about here.

    Now, this doesn't mean to say Laci isn't doing both--commenting on gun issues and trying to market knockoff designer clothing--but the chances are pretty slim.
