How about we stop calling gun owning a civil right or a human right or a Constitutionally protected right?
It's none of those things. The recent interpretation of the 2nd Amendment that you guys are enjoying so much is an anomaly, which if the country can ever come back to its senses, will be ended.
Gun ownership is no more a right than that of owning .... I almost forgot how much I hate comparisons.
I'll just say owning an object made out of metal is not a RIGHT of any kind.
The Holding from Heller: In sum, we hold that the District’s ban on handgun possession in the home violates the Second Amendment, as does its prohibition against rendering any lawful firearm in the home operable for the purpose of immediate self-defense. Assuming that Heller is not disqualified from the exercise of Second Amendment rights, the District must permit him to register his handgun and must issue him a license to carry it in the home.
Note I have bolded the following phrases: we hold--That means this is the holding
Assuming that Heller is not disqualified from the exercise of Second Amendment rights--that means a background check
permit him to register--Note the word "register".
issue him a license--Again, note the word "licence".
Background checks, registration, and licensing are permissible under Heller-McDonald
As JadeGold says, take it up with Fat Tony Scalia.
And remember, the Civic right interpretation is still alive by 4 votes!
I never said anything about Heller or even the 2nd Amendment other than I asked why not apply the same standards that Mike was thinking was a good idea, to the rest of the Bill of Rights.
Laci, for someone who thinks Heller was wrong, you sure do quote it a lot lately.
As long as there are people like Jadegold on the side of gun control (who believes that the merely owning a gun points to mental instability), then I will oppose such screening laws.
That and background checks would be super.
