Norfolk Man Shot Holding Toy Gun for the 2nd Time - This Time He's Dead



A man who was shot to death in a standoff with Virginia Beach police over the weekend was pointing a toy machine gun at the officers who shot him, according to an investigation by police.



Daniel Guy Newcomb, a 33-year-old Norfolk resident, was a suspect in an armed robbery when he was confronted by officers on Saturday afternoon. He was shot during the standoff in the 300 block of South Witchduck Road and later pronounced dead at the hospital.

The Virginian-Pilot reports that this was the second time that Newcomb had been shot by police officers while threatening them with a replica gun. The newspaper reports that in 2009, he was shot during a standoff with Norfolk police officers while wielding a starter's pistol.
What's your opinion? Can the police be faulted for mistaking that toy gun for the real thing? If not, then here's my solution.

    2. Mikeb, put yourself into the position of the police. Here is a felon with what looks like a gun. He's pointing said gun at you. What do you do? This bad guy got what he asked for. Now if he was flying mammal feces crazy and didn't know what he was doing, then I do wish that he had received proper treatment, but otherwise, he had to have known what was coming. Actions have consequences.

    I know if you had been there that you would have double tapped that perp without a second thought and then plead self-defense (omitting, of course, that you "thought it was a real gun, but couldn't, y'know, tell for sure.".

    1. I'm with Greg! Ideally the dope with the toy gun would not have been shot but is something to wring hands about? Not in this case, as the man was a criminal and even if he did not commit murder his actions, at various times could have led to deaths other than his own. SO, no I don't think Greg is an idiot but made an intelligent assessment. James

  4. There is NO good reason for having realistic-looking toy guns or pellet guns (like Airsoft guns). Too often I see reports of them being used to commit crimes or threaten people, and sometimes, like this case, they wind up with the user being killed. At least once a week these cases involve children. They need to be multi-colored, or simply avoided altogether; that tiny red tip at the end is too easy to remove or cover up or be unnoticed.

    2. Odious Bubbleson, we know that you see no reason for having real guns, too, so I'll read your comment in that light. The rest of us understand that pellet guns have a role in training for people who are disturbed by noise and recoil and also are a sport in themselves.

    3. I'm no stranger to guns, Greg (despite what you gun guyz would like to think), but I've never heard of anyone using pellet guns as "training" instruments. More typically it is a .22, in my experience.

      In any case, even if you did use a pellet gun for "training" purposes, it doesn't have to look realistic to use it for such.

      But we don't care what you think is appropriate. I don't have to have a good reason to own a legal product. I just have to have the money. You can't stand the fact that we are free to do things in this country. I, for example, find it offensive that you besmirch the Norse gods by using their names for your own, especially since you go against the religious texts of that culture, but we live in a free country. You may say what you want.

      Well you're obviously not very familiar with them either. Almost every kid that I can think of had a pellet or BB-gun well before they were given a .22 or something larger. It's a good way to learn the basics and to learn responsibility.

I have tried to be respectful to both of you, but I don't get the same in return, so I'm tired of playing that game.

      Lock and load is a silly phrase in this context. It refers to locking open the action to load the magazine. You perhaps would like me to carry locked, since that wouldn't be ready to use, but I carry cocked and locked. That locked refers to the thumb safety, not the slide stop.

      But let's notice that like Laci, you now have expressed your desire to see me shot or to see me shoot an innocent person for your own amusement. Democommie, you call me violent, and yet you want that?
