North Dakota Castle Doctrine Mentality

Different states have different versions of the Castle Doctrine Law. But the "Castle Doctrine Mentality" is universal.

35-year-old Brian Smith of Hankinson was shot by a 55-year-old man in the driveway of the man's home. He says the two didn't know one another beforehand, and there was an altercation before the shooting.

Leshovsky says the shooter claimed he was acting in self-defense, and was not immediately arrested.
What do you think? Are some of these guys a little too trigger happy?

  1. honestly don't start fights then intrude onto another persons property. If you are fighting someone, and then try to come up to their house to continue the fight then plan on getting shot. What is wrong with the homeowner defending himself?

  2. What's wrong is defending yourself by shooting someone should be reserved for extremely rare situations. Lethal threat should be the prime criterion.

  3. it said there was an altercation before the shooting, so most likely he knew what the attacker intended....or more likely the attacker said something to him directly that led him to believe he was in danger. Like "im gonna kill you" "your dead" any number of things.

    You would be surprised at what people say before they attack someone. Alot of the time they do say threating things before killing/beating.

    2. that may or may not be true. Just say for sake of argument that 80% of the time when someone says "I'm gonna kill you" or "your dead" or any variation of harmful threat. They dont actually do it. 80% dont do it even when saying it. This is your arguement for not protecting yourself?

      You really want to risk your LIFE hoping this person is all talk and wont act on what they say? And if hes part of that 20% then your just dead? Thats worth it to you?

      Chances are you have no more need of a gun to protect yourself than the man on the moon. But, since deep down you know that, you go to fantastic lengths to justify it.

    4. ok i should have just said 99 ...its basically what i meant. It makes no difference. I could be 1/2 a percent of a percent. if thats even a thing. If it could happen to you, why not be prepared for it? I'm not going to any fantastic lengths to prove anything...bad things happen to good, unsuspecting people. Many of which probably had less odds of being victimized then the average person. So because they had your line of thinking they didn't have anything to protect themselves.

      I really feel if you were victimized in such a way that happens daily in this country, you would quickly change your view. Im also sure you would regret not having anything to protect your family if a scenario like that did evolve.

      Rape your wife? rape your kids? Literally kill your whole family just to steal your electronics? There ARE people in the world that like. obviously like you said odds are low. But odds are also low of winning the lottery, but people still win. It would be horrible to be in a situation watching your family get brutalised and you cant do a thing.

    5. All you protect-the-family guys are full of it. The fact is you have a better chance of someone misusing your gun than you do of that gun being used to save the day. That makes you both stupid and irresponsible to even have the gun in the first place.

      It's not about protecting your family. It's about a fantasy that you have in your head.

    6. Mike, are you denying that someone could break into your house, raped and kill your family? Are you suggesting thats impossible to happen to you? Im curious what state you live, is it on your site somewhere? would you mind disclosing? I'm in a relatively low crime state so to speak, so im curious where your from.

    7. just as you said.... if ever given a need or reason to defend himself, or his family he would have no means to.
      luckily there are a few people left with common sense that own and carry firearms.
